After careful consideration, the Board of Directors of NYACT and NYSSIU have decided to move the Joint Fall Conference to a virtual meeting. We know that many of you work in high risk environments and/or may have travel restrictions at this time.  While cancelling the live event is disappointing, it also creates a great opportunity to continue to expand our member benefits by providing virtual training you can utilize from where you work today.

PROGRAM:

8:15-8:30 AM
WELCOME AND OPENING REMARKS

NYSSIU President-James Egner
NYACT Chair-Nichole Soriano
NYACT Director-Abby Curro

8:30-9:30 AM
RECENT IMPACTS OF THE NATIONAL EMERGENCY ON FRAUD TRENDS: AUTO & ELSEWHERE

Dave Tropiano, Strategic Sales, CARFAX Banking & Insurance Group
History demonstrates that during times of national tragedy or emergency – recessions, pandemics, or catastrophic weather events – fraud arises. Today, as many Americans struggle financially and declining profits push businesses toward potential bankruptcy, bad decisions are made to seek quick cash through insurance scams. CARFAX will share insights into how some of these scams relate to auto and other industries, and how we can continue to use data and data-driven methodology to help combat fraud and abuse in the insurance and law-enforcement sectors.

9:30-10:30 AM
THE VIRTUAL ERA OF INVESTIGATION

Mohan Deokinandan, Investigator, Farmers Insurance
Although the shift to virtual claims-handling and the age-old indicators of fraud have not changed, how we find fraud has changed forever. With a focus on auto policies we will talk about methods of virtual claims-handling and investigation, how fraudsters can defeat them, and how investigators need to become strategic and creative in attempt to discover the information necessary to prove fraud has occurred. This will be an eye-opening discussion of the recent changes industry-wide, and how investigators around the state have successfully adapted to them.

10:40-11:45 AM
UBERRIMAE FIDEI –THE CURRENT STATE OF THE LAW OF BAD FAITH AND EXTRACONTRACTUAL DAMAGES IN NEW YORK

Roy A. Mura, Esq., Mura & Storm, PLLC
Plaintiff and policyholder attorneys and public adjusters think insurers frequently act in bad faith. But do they? What is bad faith and what kind of conduct by an insurer warrants extracontractual damages in New York? This session will cover an overview of the present and proposed law of first party and third-party insurer bad faith in New York, and under what circumstances an insured or claimant may be entitled to extracontractual, consequential, treble or punitive damages.
